1. Agreement to Terms

By accessing or using the Aspire Performance platform ("Service"), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service.

2. Description of Service

Aspire Performance provides a marketing management platform for local service businesses. The Service includes content management, lead tracking, appointment scheduling, review management, and automated messaging capabilities.

3. SMS/Text Messaging Program

Program Name: Aspire Performance Business Messaging

Program Description: Automated text messages sent on behalf of local service businesses managed through the Aspire Performance platform. Messages include appointment confirmations and reminders, lead follow-up communications, review requests, missed call responses, and promotional offers from the business you contacted.

Message Frequency: Message frequency varies. You may receive up to 10 messages per month depending on your interactions with the business.

Message and Data Rates: Message and data rates may apply. Check with your mobile carrier for details about your text messaging plan.

Opt-Out: You can opt out of receiving text messages at any time by replying STOP to any message. After opting out, you will receive a final confirmation message and no further messages will be sent.

Supported Carriers: Compatible with all major US carriers including AT&T, Verizon, T-Mobile, Sprint, and others.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized access to your account.

5. Acceptable Use

You agree not to use the Service to:

• Send unsolicited or spam messages

• Violate any applicable laws or regulations

• Transmit harmful, threatening, or abusive content

• Interfere with the operation of the Service

• Attempt to gain unauthorized access to any part of the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Aspire Performance and are protected by copyright, trademark, and other intellectual property laws.

7. Payment Terms

Subscription fees are billed monthly or as agreed upon in your service agreement. Payments are processed through Stripe. All fees are non-refundable unless otherwise specified in your service agreement.

8. Limitation of Liability

Aspire Performance shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.

9. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
